Pastwalk Terms of Service

These Terms of Service ("Terms") govern your use of the Pastwalk mobile application ("Pastwalk," "the app," "the Service"), operated by Cirqular Frequencies, LLC ("we," "us," or "our"). By downloading, accessing, or using Pastwalk, you agree to these Terms. If you don't agree, please don't use the app.
1. The Service
Pastwalk converts your real-world walking and running distance into progress along historical journeys, routes, and expeditions that you choose. Distance can come from Apple Health, Google Fit / Health Connect, or be logged manually.
Pastwalk is not a medical device, a fitness or health-monitoring product, or a source of medical advice. Distance and step estimates are approximate and provided for entertainment and motivational purposes only. Consult a physician before beginning any exercise program, and do not rely on Pastwalk for any health, safety, or medical decision.
Historical content is presented for entertainment and educational framing. Route distances, waypoint placements, and historical facts are sourced with reasonable care, but some content (particularly for ancient or sparsely documented routes) is reasoned/representative rather than precisely verified. Pastwalk is not a substitute for authoritative historical research.
2. Accounts
Pastwalk creates an anonymous account automatically when you first open the app, so you can start using it without signing up. You may optionally link a persistent identity via Sign in with Apple or Google, which lets your progress survive a reinstall or new device.
You're responsible for maintaining the security of any device or account credentials associated with your use of Pastwalk. Since anonymous accounts aren't tied to a recoverable identity, we can't help you recover progress from an anonymous account if you lose access to the device it was created on and never linked a sign-in.
3. Subscriptions
Pastwalk offers optional premium subscriptions (monthly and annual) that unlock additional features, including unlimited friends and group competitions, multiple concurrent journeys, all route packs, all appearance themes, and custom point-to-point routing.
- Subscription price and billing period are shown in the app before purchase, and are charged to your Apple ID or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current subscription price.
- You can manage or cancel your subscription, and turn off auto-renewal, at any time through your device's App Store or Google Play account settings — Pastwalk does not process payments directly and cannot cancel a subscription on your behalf.
- If we offer a free trial, any unused portion is forfeited once you purchase a paid subscription.
- Prices may change; we'll provide notice as required by Apple's and Google's respective policies before any change takes effect for existing subscribers.
4. Acceptable Use
You agree not to:
- Use Pastwalk for any unlawful purpose, or in a way that violates Apple's or Google's platform policies.
- Attempt to falsify walking/running distance data in a way intended to defraud other users (for example, in group challenges) or to abuse free-tier limits.
- Attempt to interfere with, disrupt, or gain unauthorized access to Pastwalk's systems, including bypassing bot/abuse protections.
- Harass, impersonate, or abuse other users through the friends or group challenge features.
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except as permitted by applicable law.
We may suspend or terminate accounts that violate these Terms.
5. User Content
Usernames and custom routes (start/end points you create with the custom route builder) are your content. You're responsible for what you create and share, and you agree not to submit anything unlawful, infringing, or abusive. We may remove content or restrict features if we reasonably believe they violate these Terms.
6. Intellectual Property
Pastwalk's app, design, historical route content, and branding are owned by Cirqular Frequencies, LLC, or licensed to us, and are protected by applicable intellectual property laws. These Terms don't grant you any right to use our trademarks, logos, or branding without our prior written permission.
7. Disclaimers
Pastwalk is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that distance/health data synced from third-party sources (Apple Health, Google Fit, Health Connect) will always be accurate.
8. Limitation of Liability
To the maximum extent permitted by law, Cirqular Frequencies, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Pastwalk, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of Pastwalk will not exceed the amount you paid us, if any, in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Termination
You may stop using Pastwalk and delete the app at any time. We may suspend or terminate your access to the Service if you violate these Terms. You can delete your account and data directly in the app (Settings → Account → Delete Account) or by contacting privacy@pastwalk.app, as described in our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you within the app. Continued use of Pastwalk after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the state in which Cirqular Frequencies, LLC is organized, without regard to conflict-of-law principles, except where applicable consumer protection law provides otherwise.
